2. Eligibility to Bid and Purchase

All bidders and purchasers must:

• Be at least eighteen 21 years of age for cigars and handguns (where applicable).
• Be at least 18 years of age for general goods and long guns (where applicable).
• Be at least twenty-one 21 years of age where required by applicable federal, state, or local law.
• Know and comply with all applicable federal, state, and local laws and regulations in their area.
• Provide valid identification and any documentation requested prior to shipment or transfer of regulated products.

We reserve the right to refuse service, deny bidding privileges, cancel transactions, or refuse shipment or transfer of any item at our sole discretion.

3. Firearms Sales and Transfers

All firearm sales are subject to all applicable federal, state, and local firearms laws and regulations, including all Federal Firearms License (FFL) requirements.

Firearm Transfer Requirements

• Firearms purchased through auction may only be shipped to a valid Federal Firearms License (FFL) holder where required by law.
• The purchaser is responsible for arranging shipment to a licensed FFL dealer in their state of residence.
• The receiving FFL dealer must provide a signed copy of their license before shipment will be processed.
• All firearm purchasers are subject to required background checks and transfer procedures.
• If a purchaser fails a background check or is otherwise prohibited from possessing a firearm, the sale will be canceled and applicable fees may be retained.

Restricted States and Jurisdictions

Firearms may be shipped to eligible purchasers in states where lawful; however, shipments will not be made to any state, locality, or jurisdiction listed in our Firearms Terms & Conditions exclusion list.

The purchaser is solely responsible for understanding and complying with the laws applicable to their jurisdiction.

4. Cigar and Tobacco Product Sales

All cigar and tobacco-related sales are subject to applicable federal, state, and local tobacco laws and regulations, including the laws of the State of Georgia.

Georgia Sales Limitation

At this time, cigars and tobacco products are only offered for sale and shipment within the State of Georgia.

By purchasing cigars or tobacco products, the purchaser certifies that they meet all minimum age requirements under Georgia law and any other applicable laws.

We reserve the right to verify age prior to completing any tobacco-related transaction.

5. Sales Tax and Tax Exemption

Applicable sales tax will be added to all purchases unless a valid sales tax exemption certificate is provided and accepted prior to completion of the transaction.

Resale Purchases

If an item purchased at auction is being acquired for resale purposes, the purchaser must provide a valid and properly completed sales tax exemption or resale certificate before payment is finalized.

• Failure to provide valid exemption documentation prior to invoicing or payment processing will result in applicable sales tax being charged.
• The purchaser is responsible for ensuring that all exemption documentation is accurate, complete, and legally valid.
• We reserve the right to reject incomplete, expired, or otherwise invalid exemption documentation.

6. Payment Terms

Payment is due within the timeframe specified on the auction listing or invoice.

Accepted payment methods may include credit card, debit card, certified funds, electronic payment, or other approved methods.

Failure to complete payment within the required timeframe may result in:

• Cancellation of the sale;
• Suspension or termination of bidding privileges;
• Relisting of the item; and/or
• Additional fees or collection efforts where permitted by law.

7. Shipping and Delivery

Shipping costs, insurance, transfer fees, taxes, and handling charges are the responsibility of the purchaser unless otherwise stated.

• Firearms will only be shipped in compliance with applicable laws and regulations.
• Tobacco products will only be shipped within Georgia where legally permitted.
• We are not responsible for delays caused by carriers, regulatory requirements, weather, or other events beyond our control.

Risk of loss transfers to the purchaser upon delivery to the carrier or receiving FFL dealer, where applicable.

8. Auction Finality

All auction sales are final unless otherwise required by law.

Descriptions, photographs, and condition statements are provided as a courtesy and are believed to be accurate; however, all items are sold “AS IS,” “WHERE IS,” and with no warranties or guarantees, express or implied.
